These Terms and Conditions, including the SMS Terms of Service below (collectively, the “Terms”), govern your use of fuelamericafranchise.com (the “Site”), submission of information through the Site, and participation in text-message programs offered by Fuel America Franchise, LLC (also referred to as “Fuel America Franchising,” “Fuel America,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. Text-message consent is requested separately and is optional.
The Site provides general information about the Fuel America franchise opportunity. Site content is for informational purposes and may be changed without notice. You may use the Site only for lawful purposes and may not interfere with its operation, attempt unauthorized access, introduce malicious code, or misuse Site content or forms.
Nothing on the Site, in a text message, email, telephone call, presentation, or other communication constitutes an offer to sell a franchise. A franchise offering may be made only through delivery of a current Franchise Disclosure Document and in compliance with applicable law. Registration of a franchise offering by a state does not constitute approval or endorsement of the offering.
Fuel America may offer separate informational and marketing text-message communications to people who inquire about the Fuel America franchise opportunity and affirmatively opt in to the applicable category.
Informational messages may include responses to your inquiry, delivery or follow-up concerning requested franchise materials, scheduling and appointment reminders, candidate-profile or application next steps, and related status or process updates.
Marketing messages may include information about the Fuel America franchise opportunity, educational resources, investment or qualification topics, invitations, reminders to schedule a call, and ongoing franchise-development or promotional follow-up.
You enroll only by entering your mobile number on a Fuel America franchising form and selecting the unchecked box for the message category you want to receive. Selecting one category does not enroll you in the other category. You may submit a franchise inquiry without selecting either SMS box. Consent to receive text messages is not a condition of purchase, eligibility, or submitting an inquiry.
By opting in, you confirm that you are the subscriber or customary user of the mobile number provided and authorize Fuel America and its service providers to send messages to that number using automated technology where permitted. Your consent applies only to the selected category or categories.
Message frequency varies based on your selections, activity, and stage in the franchise-development process. Message and data rates may apply. Your mobile carrier’s rates and terms govern any charges.
Reply STOP to any Fuel America text message to opt out. You may receive one final confirmation message. To request assistance, reply HELP, email franchising@fuelamerica.us, or call (860) 748-4835. If you later want to receive messages again, follow a new opt-in process made available by Fuel America.
Opting out of text messages does not withdraw a request for us to contact you through another channel or affect non-SMS communications that are permitted by law. You may separately ask us to stop other marketing communications.
Text-message delivery is subject to network availability, carrier systems, your device, and other factors outside our control. Carriers are not liable for delayed or undelivered messages. We do not guarantee that every message will be delivered or received.
Our collection and use of information is described in our Privacy Policy.
Fuel America Franchise, LLC will not share consumer mobile numbers, mobile opt-in data, or SMS consent with any third parties or affiliates for their own marketing or promotional purposes. This restriction does not apply to aggregators and service providers of text-messaging services that act on our behalf and may use the information only to provide those services. We will not sell or rent your personal information.
We may change, suspend, or discontinue the Site or an SMS program, and may update these Terms, subject to applicable law. The revised Terms will be posted on this page with a new effective date. We may stop messaging a number if consent cannot be verified, if the number is reassigned, if continued messaging presents a compliance or security risk, or if you opt out.
Fuel America names, logos, content, images, and other materials on the Site are owned by or licensed to Fuel America and may not be copied, modified, distributed, or commercially used without permission. The Site may link to third-party websites or services. We are not responsible for third-party content, availability, or practices.
To the fullest extent permitted by law, the Site and related communications are provided on an “as is” and “as available” basis without warranties of any kind. Site content is not a substitute for the Franchise Disclosure Document, professional advice, or your own investigation of a franchise opportunity. Nothing in these Terms limits rights that cannot lawfully be limited.
